Website Terms and Conditions of Use Relating to www.peterprentjies.co.za

General Information

We wish to grant you the complete satisfaction with your order and the service we provide. When you place an order online with us you do so in the confidence that the terms and conditions outlined apply and by placing an order with us, you are agreeing to accept these terms and conditions.

We reserve the right to change the terms and conditions at any time. Any such changes will take effect when they are placed on the Peterprentjies website and should be read on each occasion you use the site. Continued use of the website signifies your acceptance to be bound by the latest terms and conditions.

These Terms and Conditions (“the Terms and Conditions”) govern you(“the Client”) use of the Peterprentjies (“Provider”) website located at the domain name www.peterprentjies.co.za (“the Website”). By accessing and using the Website, the Client agrees to be bound by the Terms and Conditions set out in this legal notice. The Client may not access, display, use, download, and/or otherwise copy or distributes Content obtained on the website for marketing and other purposes without the consent of the Provider.

MORE TERMS & CONDITIONS

By using this Website or communicating with the Provider by electronic means, the Client consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing.

The Website (www.peterprentjies.co.za) sells [baby/kids clothing, gifts, prints, gifts & accessories] online.  The use of any product or service bought from this Website is at the purchaser’s risk. The purchaser/ Client indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website. 

The private information required for executing the orders placed through the e-commerce facility, namely the Client’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to the third party delivering the product (Courier Service).  Credit card details are not kept by the Provider under any circumstances.

The Provider cannot be held responsible for security breaches occurring on the Client’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the Client may inadvertently have installed on his/her device.

The Provider will supply all goods to the delivery company in good order. All products will undergo a quality assurance check before leaving the Provider’s premises. The Provider will not be held liable for the condition of goods arriving at the Client’s chosen delivery address.

All online credit card payments are processed by Payfast.  Card Holders may go to www.payfast.co.za to view Payfast’s security policies.

Payment Options and Pricing

All transactions will be processed in South African Rands (ZAR).

The Provider endeavours to offer the Client competitive prices on current products; you’re total order price will include the price of the purchase plus shipping charges. If the Client wishes to collect the parcel, the Collection option can be selected on Checkout. The Provider will not be held liable for parcels which was not delivered due to the Client choosing the incorrect shipping method on Checkout.

The Provider reserves the right to change pricing at any time without prior notice, however if the order was placed and payment for the product/s was made before the increase, the Client will only pay the increased price for future purchases.

Peterprentjies Electronic Gift Card

The bearer of the Peterprentjies Electronic Gift Card may use the Electronic Gift Card to purchase only the merchandise stated on the Electronic Gift Card from only the Peterprentjies online store.

The Electronic Gift Card is valid for a period of 1 (one) years from date of activation / when you receive your “coupon code” for the online store.

Should you not utilise the full value of your Electronic Gift Card on your first purchase, the balance will not be transferred for another purchase. The Gift Card / Coupon Code can only be used ones.

The Electronic Gift Card cannot be topped up, however it can be sent to another user.

Should the Electronic Gift Card be deleted/lost, Peterprentjies will be not be liable for any reimbursement of any nature. The email can be resent, but only to the original email if the order number has been provided to us.

The usage of the Electronic Gift Card is solely at the risk and discretion of the Client.

Ensure that you purchase the correct gift card for the correct products you wish to purchase. Products not stated on the gift card, cannot be purchased with the Gift Card/Coupon code.

The Electronic Gift Card may not be:

– used to purchase products which is not stated on the Electronic Gift Card

– used more than one purchase. It can only be used once for security purposes.

– Please ensure that you use the total of the Electronic Gift Card in one purchase. The system will not allow you to make more than one purchase with the same coupon code / Gift Card.

– exchanged for cash or refunded

– for security reasons, the emailed received with the Electronic Gift Card, Coupon Code and Instructions on how to use the Electronic Gift Card, should be kept in a safe place. If stolen, it may still be used to make unauthorised / fraudulent purchases.

– Lost (email deleted) or Stolen Gift Card / Coupon Codes will not be replaced or refunded. However, should you be in possession of the Order Number of the purchase made on the Electronic Gift Card, we will be able to resend the Coupon Code for the Electronic Gift Card to you again.

Purchased Gift Card:

Once the Gift Card has been purchased the client will receive an email with the following:

– Digital Gift Card

– Coupon Code (Used on the website)

– Instructions on how to use the Gift Card on the website

On the Checkout page of the Website, the Client has the option to collect their order free of charge. There are only one address where the products can be collected. The Provider will not be held liable if the incorrect shipping option has been chosen by the Client.

All parcels under 2kg will be shipped for R80. An additional fee will apply if the parcel exceeds the weight of 2kg which the Client will be invoiced for additionally before shipment.

All products in stock on the online store will be received within 2-5 working days. If the parcel was not received by the Client within 5 working days, please contact us on info@peterprentjies.co.za.

Lead time is dependent on stock availability. Should we have stock available, orders will be dispatched the same day (working day) or next day (working day) provided payment is validated. Shipment does not take place on weekends or public holidays.

The Provider allows back-orders on specific products. Should the product not be in stock please allow 10 working days plus freight transit time. This will allow for manufacturing and delivery to our warehouse.

Every effort will be made to deliver parcels within the indicated time, however unforeseen circumstances may cause delays. Should we be faced with such an occurrence the Provider will contact the Client via email and provide a revised shipping schedule.

Please ensure the correct shipping address is provided the Provider. The risk will pass to the Client once the order has left the Provider’s premises.

 Undeliverable packages

Should this event take place every attempt will be made to contact the Client to make arrangements for re-shipment.

The Provider allows back-orders on specific products. Should the product not be in stock please allow 10 working days plus freight transit time. This will allow for manufacturing and delivery to our warehouse.

Each product on the Website is individually handmade and small variations may occur between each product.

The provision of goods and services is subject to availability. In cases of unavailability, the provider will refund the client in full within 30 days. The Provider allows back-orders on specific products which will be delivered after 10 working days. The Provider does not allow cancellation of orders by the Client after payment has been made. 

The Provider reserves the right to cancel an order for which payment has already been received.  This may occur if stock is insufficient or the quality of goods ordered does not meet the Provider’s standards.  Should the Provider exercise this right, the Client will receive a full refund with no deductions.

Any complaints regarding the standard and quality of the product or products bought by consumers through the e-commerce facility should be directed to the Owner, info@peterprentjies.co.za. If the fault was on the Provider’s side, the Client will be refunded in full, however if any damages or what the case might be occurs after shipment, the Provider will not be liable.

Provider reserves the rights to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the Client’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The Client’s continued use of this Website following the posting of changes or updates will be considered notice of the Client’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

Provider provides certain information on the Website. Content currently or anticipated to be displayed on this Website is provided by Provider, its affiliates and/or subsidiary, or any other third party owners of such content. The Provider reserve the right to make any changes to the Website, the Content, or to products and/or services offered through the Website at any times and without notice. All rights in and to the Content is reserved and retained by the Provider. Except as specified in these Terms and Conditions, the Client is not granted a license or any other right including without limitation under Copyright, Trademark, Patent or other Intellectual Property Rights in or to the Content.

The Client understands that all the designs and trademarks are registered to the Provider and hereby accept the terms and conditions. I undertake not to copy/duplicate the trademarks and designs directly or indirectly in anyway and understand the legal implications thereof. Should I be found to be in violation of this agreement I understand that I will be held liable for all legal costs incurred by the Provider for any civil action or any legal action deemed necessary against me.

The provider have tried to display all garment colours accurately, however browser software and monitor displays may sometimes cause colour variations and the provider cannot be responsible for any discrepancies between the image and the actual product.

The Website and all Content on the Website, including any current or future offer of products or services, are provided on an “as is” basis, and may include inaccuracies or typographical errors. The Owners make no warranty or representation as to the availability, accuracy or completeness of the Content. Neither Provider nor any holding company, affiliate or subsidiary of Provider, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if Provider is expressly advised thereof.

The Client may visit the Website without providing any personal information. The Website servers will in such instances collect the IP address of the Client computer, but not the email address or any other distinguishing information. This information is aggregated to measure the number of visits, average time spent at the Website, pages viewed, etc. Provider uses this information to determine use of the Website, and to improve Content thereon. Provider assumes no obligation to protect this information, and may copy, distribute or otherwise use such information without limitation.

This Website is controlled, operated and administered by the Provider from its offices within the Republic of South Africa. Access to the Website from territories or countries where the Content or purchase of the products sold on the Website is illegal is prohibited. The Client may not use this Website in violation of South African export laws and regulations. If the Client accesses this Website from locations outside of South Africa, that Client is responsible for compliance with all local laws. If any of the provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect. These Terms and Conditions constitute the entire agreement between the Provider and the Client with regard to the use of the Content and this Website.
